1. Acceptance of Terms

By accessing or using PlotMyGarden ("the app", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app. These terms apply to all visitors and users of PlotMyGarden, including both free and paid subscribers.

2. Description of Service

PlotMyGarden is a garden planning application that allows users to design garden layouts, track plant placements, manage seed inventories, view planting calendars, and access weather forecasts and companion planting information. A free account is required to use the app.

PlotMyGarden is offered as a free plan with an optional paid Pro subscription. Pro adds features such as unlimited gardens, the plant wishlist, the garden timeline view, the grow-mode lifecycle tracker, AI photo uploads, and a higher daily AI message quota. The free plan continues to receive new features over time. Current pricing and the up-to-date Pro feature list are shown on the pricing page within the app.

3. User Responsibilities

By using PlotMyGarden, you agree to:

  • • Use the app for lawful, personal, and educational purposes
  • • Not attempt to reverse engineer, decompile, or extract the source code for commercial redistribution
  • • Not use automated scripts, bots, or crawlers to access the app in a way that degrades the experience for other users
  • • Maintain the security of your account credentials
  • • Not misrepresent PlotMyGarden as your own product or remove attribution when sharing or redistributing
  • • Not abuse the AI chat — specifically, no jailbreak attempts, prompt-injection, attempts to extract our system prompts, mass-automated requests, or use of the AI to generate content unrelated to gardening
  • • Not upload images that contain personal data of third parties without their consent, illegal content, copyrighted content you do not own, or any content prohibited by applicable law

4. Intellectual Property

The PlotMyGarden name, logo, design, source code, and original content are the intellectual property of the PlotMyGarden project. The plant data, companion planting information, and hardiness zone data included in the app are compiled from publicly available horticultural resources and are provided for informational purposes.

Garden layouts, designs, and data that you create using PlotMyGarden belong entirely to you. We claim no ownership or rights over your user-created content beyond the limited license described in Section 8 (AI Chat Features), which exists solely to let us provide the AI feature for you.

5. Plant Data & Growing Information

The plant data, companion planting relationships, hardiness zone estimates, planting calendars, and growing recommendations provided by PlotMyGarden are for informational and planning purposes only. While we strive for accuracy, this data should not be considered professional agricultural, horticultural, or botanical advice.

Growing conditions vary significantly based on local climate, microclimate, soil conditions, elevation, rainfall, and many other factors. Always verify planting information with local agricultural extension services, seed packet instructions, and experienced local gardeners. PlotMyGarden's hardiness zone detection uses an estimation algorithm and may not precisely match the official USDA hardiness zone map for your exact location.

6. Subscription, Billing & Cancellation

The Pro subscription is offered with a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription auto-renews at the interval you selected at checkout (monthly or yearly) using the payment method you provided. Current prices are displayed on the pricing page within the app.

Cancellation. You can cancel at any time through the Stripe customer portal accessible from your account settings, or in-app. Cancellation takes effect at the end of the current billing period; you keep Pro access until then. After that, the account reverts to the Free plan; your garden data is retained, but some Pro-only features become read-only.

Renewal price changes. We may change subscription prices. If we do, existing subscribers will be notified by email before any price change takes effect on their next renewal, with enough lead time to cancel.

Refund policy. We offer a 7-day money-back guarantee on your first paid charge: contact us within 7 days of your first charge and we will refund the full amount. Separately, if you are a consumer based in the European Union or United Kingdom, you have a statutory 14-day right of withdrawalfrom your first paid charge under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013; starting the subscription does not waive this right. After these windows, we do not refund unused time on an active subscription — instead, cancel anytime to stop the next renewal while keeping access until the period ends.

Failed payments. If a renewal payment fails, Stripe will retry per its standard retry schedule. If all retries fail, the subscription is cancelled and the account downgrades to Free. Garden data is retained.

Chargebacks. Initiating a chargeback or payment dispute without first contacting our support team may result in your account being suspended while the dispute is resolved.

7. Payment Processing (Stripe)

Payments are processed by Stripe, Inc. We do not see, store, or transmit your payment card number; all card data is handled by Stripe's PCI-DSS Level 1 certified infrastructure. By starting a subscription you also agree to Stripe's consumer terms and Stripe's privacy policy. On our side we store only the Stripe customer ID, subscription ID, plan, billing period dates, cancellation flag, and similar non-card metadata necessary to manage your subscription.

8. AI Chat Features

PlotMyGarden offers an in-app AI chat assistant. The following terms apply:

  • Quotas. Free accounts receive a small daily message allowance; Pro accounts have a higher daily allowance. The exact figures are shown in the chat interface and may change over time.
  • Third-party AI provider. The AI is provided by a third-party AI provider, identified in our Privacy Policy. Each chat turn sends your message, a snapshot of your active garden, relevant plant data, and (Pro only) optionally one uploaded photo to that provider to generate the response.
  • Not professional advice. AI-generated suggestions are informational only. They may be inaccurate, incomplete, or unsuitable for your local conditions. You are responsible for verifying recommendations before acting on them. Do not rely on the AI for medical, veterinary, food-safety, or legal advice.
  • Tool-use confirmations. The AI may propose changes to your garden (adding or removing plants, layout adjustments). These proposals are never applied automatically— you must explicitly confirm each suggestion before it takes effect.
  • Photo uploads (Pro only). Capped at 2 MB per photo; JPEG, PNG, or WebP only. Do not upload images containing personal data of third parties without their consent, illegal content, or content you do not have the right to share.
  • Abuse.We may suspend or terminate AI access — or the entire account — if we detect prompt-injection attempts, mass automation, attempts to extract our system prompts, or other misuse of the feature.
  • Limited content license. To operate the AI feature for you, you grant us a limited, worldwide, non-exclusive, royalty-free license to process the content you submit through the chat (text and images) for the sole purpose of generating responses, storing your conversation history, and improving the reliability of the feature. We do not use your content to train AI models, and this license terminates when you delete the conversation or your account.

9. Newsletter

Our newsletter is opt-in only and uses double opt-in: you submit your email and must confirm via the link in the confirmation email. We send the newsletter occasionally (typically product updates and major releases). You can unsubscribe at any time using the link in every newsletter email or via the contact page. Newsletter emails are delivered through Brevo; see our Privacy Policy for processing details.

10. Disclaimer of Warranties

PlotMyGarden is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

  • • The app will be uninterrupted, error-free, or bug-free
  • • Plant data will be perfectly accurate for all regions and conditions
  • • Weather data will be accurate or available at all times
  • • Your data will be preserved indefinitely or that backups will always be available
  • • Companion planting recommendations will guarantee specific results
  • • AI-generated recommendations will always be accurate, complete, or appropriate for your local conditions

11. Limitation of Liability

To the maximum extent permitted by applicable law, PlotMyGarden and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • • Crop losses or poor harvests based on app recommendations
  • • Loss of data due to technical issues, account deletion, or other causes
  • • Inaccurate plant or weather information
  • • Inability to access the app due to technical issues
  • • Any actions taken based on information provided by the app, including AI-generated suggestions
  • • Subscription charges resulting from a cancellation attempt that was not completed through the documented in-app or Stripe customer portal flow

You acknowledge that gardening involves inherent risks and that PlotMyGarden is a planning tool, not a guarantee of gardening success. Nothing in this section limits any liability that cannot be limited under applicable consumer-protection law.

12. Data and Privacy

Your use of PlotMyGarden is also governed by our Privacy Policy and Cookie Policy, which describe how your data is collected, stored, and processed. Key points:

  • • An account with your name, email, and password is required to use the app
  • • Your garden designs and settings are stored on our servers
  • • We use Brevo for transactional emails and (opt-in) the newsletter
  • • We use Stripe to process Pro subscription payments; we never see or store your card number
  • • We use a third-party AI provider (currently OpenAI) for the AI chat feature; messages, a garden snapshot, and any uploaded photo are sent to that provider
  • • Weather requests are made to the Open-Meteo API using only latitude/longitude
  • • We do not sell or share your personal data for third-party marketing

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Routine updates (clarifications, typo fixes) take effect immediately upon being published. Material changes — new fees, changed refund terms, new sub-processors, or material expansions of the data we collect — will be communicated in-app at least 14 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of PlotMyGarden after a change has taken effect constitutes acceptance of the revised terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from or relating to the use of PlotMyGarden shall be resolved through good-faith negotiation before pursuing any formal legal proceedings. Nothing in this section limits any consumer rights you may have under the law of your country of residence.

15. Proprietary Software

PlotMyGarden is proprietary software. The source code, design, and all associated assets are the property of PlotMyGarden and may not be copied, modified, distributed, or reverse engineered without prior written permission.
